1. Who we are
ExemptLand (“ExemptLand”, “we”, “us”, “our”) is a software product that helps Texas landowners prepare their own property-tax-exemption applications and annual property-tax protests. By creating an account or paying for a plan, you agree to these Terms of Service.
2. We are not a tax agent or attorney
ExemptLand is a software tool. We are not a licensed tax preparer, certified public accountant, attorney, real estate broker, or property tax representative. We do not file applications on your behalf. We do not represent you before any county appraisal district, the Texas Comptroller, or any court. Information generated through ExemptLand is not legal, tax, or financial advice.
You are responsible for reviewing every document we generate, signing it yourself, and submitting it to your county appraisal district. You are responsible for confirming that your property and activities qualify under Texas Tax Code §23.51 (1-d-1 agricultural valuation), §23.521 (wildlife management), Texas Property Tax Code §11.13 (homestead), and any other applicable rules and county-specific guidance.
3. Account eligibility
You must be at least 18 years old, the legal owner of (or authorized agent for) the Texas property you list in ExemptLand, and able to enter into a binding contract. You agree to provide accurate, current information and to keep your login credentials confidential.
4. Plans, pricing, and billing
Pricing is published at exempt.land/pricing and varies by product and acreage tier. Some plans are one-time purchases that grant access to a specific deliverable (for example, a wildlife management plan PDF for one property). Other plans are annual subscriptions that automatically renew until canceled.
Payments are processed by Stripe, Inc. By providing a payment method you authorize ExemptLand and Stripe to charge that payment method for the plan you select. Annual subscriptions automatically renew at the then-current price unless canceled before the renewal date through your account settings or the Stripe billing portal.
All prices are in U.S. dollars and exclude any sales or use tax that may apply. Texas does not currently impose sales tax on the digital services ExemptLand offers; if that changes, applicable tax will be added at checkout.
5. Cancellations
One-time purchases grant access to the selected deliverable and do not renew. For annual subscriptions, you may cancel at any time to stop future renewals; we do not pro-rate refunds for the unused portion of a current term.
6. License to use the software
Subject to your compliance with these Terms and your active plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use ExemptLand for your own personal, non-commercial purpose of preparing exemption filings for property you own or are authorized to manage. You may not resell, sublicense, scrape, reverse-engineer, or use ExemptLand to provide tax-preparation services to third parties without a separate written agreement with us.
7. Your content
You retain ownership of any photos, documents, parcel data, and other content you upload (“Your Content”). You grant us a worldwide, non-exclusive license to host, process, and display Your Content as needed to operate ExemptLand and deliver the services you purchased. You represent that you have all rights necessary to grant this license.
8. Generated documents
ExemptLand prepares draft documents (including but not limited to TPWD Form PWD-885, Form 50-129, homestead and protest packets) using information you provide and publicly available data. You are responsible for reviewing every page, correcting errors, signing the document yourself, and filing it with the appropriate county appraisal district by the applicable deadline. We make no guarantee that any application will be approved.
9. Acceptable use
You agree not to:
- use ExemptLand for any unlawful purpose or in violation of any applicable law;
- upload content that is fraudulent, defamatory, or that infringes a third party’s rights;
- attempt to gain unauthorized access to our systems or other users’ accounts;
- use automated tools to scrape, copy, or extract data from ExemptLand other than via our public APIs.
10. Disclaimers
EXEMPTLAND IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT ANY APPLICATION PREPARED THROUGH EXEMPTLAND WILL BE APPROVED, THAT ANY EXEMPTION WILL BE GRANTED, OR THAT YOUR PROPERTY TAX BILL WILL BE REDUCED.
11. Limitation of liability
To the maximum extent permitted by law, ExemptLand and its founders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost savings, or denied exemptions, arising out of or relating to your use of ExemptLand. Our total liability for any claim relating to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
12. Termination
You may delete your account at any time by emailing support@exempt.land. We may suspend or terminate your access if you breach these Terms, fail to pay an amount due, or if we are required to do so by law. Sections 2, 7, 10, 11, 14, and 15 survive termination.
13. Changes to the service or these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and post the updated Terms on this page with a new “Last updated” date. Continued use of ExemptLand after changes take effect constitutes acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of ExemptLand will be resolved in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.
